What does the Living Will consist of?

We put at your disposal a very simple form to leave your instructions on the care or treatments you want or do not receive and to appoint the representatives to act as interlocutors before the responsible medical team. This document can be made by a person of legal age, capable and free, and with the same freedom and requirements, its content can be revoked or modified. Keep in mind that if the patient cannot and there is no advance directive document, the relatives will intervene.

We take care of registering the document in the register of advance directives of the Comunidad Autónoma de Castilla y León, and we will even electronically send a copy of them to the registry if this mechanism is enabled.

The living will in Castilla y León is a document that contains the previous instructions to ensure compliance with the wishes expressed in advance by anyone about the care or treatment that they wish or do not receive at those times in the that your physical or mental situation prevents you from expressing them personally. They are the maximum expression of respect for the will of patients in the health field, serving as an instrument so that it is taken into account in clinical decision-making, despite having manifested itself at an earlier time.

In Castilla y León the living will can be done by anyone who is over 18 years of age, capable and who acts freely. However, unlike what happens in other autonomous communities of the Spanish territory, minors are not allowed to process the living will. In these cases, only the minor’s father, mother or legal guardian may process and manage the minor’s living will or decide instead when the time comes.

This document can be created by filling in an available template, in paper or digital format. As indicated in the regulations, there are 3 ways to process the living will in Castilla y León and thus register the previous instructions: before a notary, before three witnesses or before the Administration service personnel. In the case of witnesses, they must have full capacity to act and must not be related to the grantor by kinship of up to 2nd degree of consanguinity, or by affinity, or with a patrimonial or other binding relationship.

At the time of processing the living will or the previous instructions there is the possibility of appointing one or more representatives who will act as an interlocutor with the doctor or healthcare team helping the interpretation of the will that the grantor has manifested in the advance directive document. The designated representative or representatives must avoid any conflict of interest to ensure that decisions are made solely in the interest of the patient.

In order to process the living will in Castilla y León it is necessary to provide the following documentation:

  • Document registration request signed by the grantor and the representative.
  • IDs or passports of the grantor, the witnesses (if applicable) and the representative (if applicable).
  • Write of acceptance of the representative, if there is one designated.
  • If it is with witnesses, responsible declaration of the witnesses stating that they meet the aforementioned requirements.
  • If it is before a notary, the notary himself will be in charge of sending all the documentation electronically.

What regulations exist to regulate the Living Will in Castilla y León?

In Castilla y León, the living will, after regulation at the national level in 2002, is managed and processed based on a Decree published by the Junta de Castilla y León in 2007.

Decree 30/2007, of March 22, which regulates the document of prior instructions in the health field and creates the registry of prior instructions for Castilla y León.
