What does the Living Will consist of?

The living will in País Vasco is a document that defines the process by which a person plans the health care that he or she wishes to receive or reject in the future, in particular when they are not able to make decisions for herself, as a result of the doctor-patient relationship and, as far as possible, made with the participation of a representative appointed by the patient.

In País Vasco, a living will can be made by any person who is qualified and acts freely, including minors. Any patient has the right to participate in the care plan and healthcare teams have the professional and legal responsibility to ensure this participation, taking into account that good medical practice is no longer so if it does not respect the will of the sick person.

This document can be created by filling in an available template, in paper or digital format. According to the regulations, there are 3 modalities when it comes to processing the living will in the Basque Country and thus registering advance directives: before a notary, before three witnesses or before the person in charge of the registry. In the case of witnesses, they must be of legal age, with full capacity to act, without kinship up to the 2nd degree, neither marriage, common-law partner, or common law union, nor patrimonial relationship.

When processing the living will or advance directives it is very important to appoint a representative to represent the patient and who, if necessary, can help in the interpretation of the document, stating their acceptance. To guarantee their impartiality, that person may not be both a witness, the notary or the person responsible for the registry, or a person with a possible conflict of interest.

In order to process the living will in the Basque Country, it is necessary to provide the following documentation:

  • Advance Directive Document.
  • Photocopies of the D.N.I. or passport of the intervening parties: grantor, witnesses (if any) and representative (if any).
  • If notarized, in addition: authorized copy of the Advance Directive Document.
  • If it is before an official, in addition: authentic copy of the Advance Directive Document.

What regulations exist to regulate the Living Will in País Vasco?

In País Vasco the living will, after being regulated at the national level in 2002, is managed and processed based on a Law published by the Gobierno Vasco also in 2002.

Law 7/2002, of December 12, of the Vasco Parliament, on Advance Wills in the field of health.

Decree 147/2015, of July 21, approving the Declaration on the Rights and Duties of people in the Vasco health system.

Decree 270/2003, of November 4, of the Gobierno Vasco by which the Vasco Registry of Advance Willing Wills is created.

Order of November 6, 2003, of the Minister of Health, by which the automated file of personal data called “Vasco Registry of advance directives” is created.

Law 11/2016, of July 8, to guarantee the rights and dignity of people in the final process of their life.
