What does the Living Will consist of?

This document can be made by a person of legal age, capable and free, and with the same freedom and requirements, its content can be revoked or modified. Keep in mind that if the patient cannot and there is no advance directive document, the relatives will intervene.

The living will in Navarra is called an advance directive document
The living will in Navarra is a document through which a person expresses his instructions on the health care he wishes to receive when he is not in a position to express his will. The healthcare team responsible for patient care in the event that the patient cannot express his or her wishes is obliged to respect their advance decisions.
In Navarra the living will can be made by any person over sixteen who is qualified and acts freely. Contrary to how it happens in other autonomous communities, in Navarra minors under sixteen can process the living will on their own, as long as they are emancipated. Otherwise, only the father, mother or legal guardian of the minor may decide on what to do and how to act on the health care to apply to the minor when the time comes.
This document can be created by filling in an available template, in paper or digital format. According to the regulations, there are 3 modalities when processing the living will in Navarra and thus registering advance directives: by a notary, by three witnesses or by the official or health professional. In the latter case, it may be the personnel in charge of the Advance Directive Registry or professionals from the Health Service-Osasunbidea of Navarra.
When processing the living will or advance directives, there is the possibility of appointing a representative, whose role will be to enforce the instructions contained in the document and in the event that the situation is not explicitly contemplated in it, it will ensure that the decisions that it believes that the grantor would have preferred are made in the case of being in a position to express their decision, always seeking their greatest benefit and respect for their dignity.
In order to process the living will in Navarra, it is necessary to provide the following documentation:
- Application for registration in the Registry.
- Advance Directive Document.
- Photocopies of the D.N.I. or passport of the intervening parties: grantor, witnesses (if any) and representative (if any).
- If it is before a notary, in addition: authenticated copy of the Advance Directive Document.
- If it is before an official, in addition: formalization document before a public employee.

In Navarra, the living will, after regulation at the national level in 2002, is managed and processed based on a Foral Decree published by the Government of Navarra in 2003.
