What does the Living Will consist of?

The living will in Murcia is a document in which a person expresses in advance the wishes about the medical actions that must be taken into account in case of being in a situation in which the circumstances do not allowed him to freely express his will. Such wishes must be respected and fulfilled by the healthcare team that intervenes when the person who has granted the document is unable to express their wishes due to physical or mental deterioration.
In Murcia the living will can be made by any person of legal age, capable, free and who is not legally incapacitated. Contrary to how it happens in other autonomous communities, in the Region of Murcia minors cannot process the living will on their own. In these cases, only the father, mother or legal guardian of the minor may decide what to do and how to act on the medical treatment to be applied to the minor when the time comes.
This document can be created by filling in an available template, in paper or digital format. According to the regulations, there are 3 modalities when it comes to processing the living will in Murcia and thus registering the prior instructions: by a notary, with three witnesses or before the official or public employee in charge of registering instructions previous.
When processing the living will or prior instructions, there is the possibility of appointing a representative who will be the valid interlocutor between the patient and the healthcare team in making decisions about the medical treatment to be apply to the patient. The representative will also be the person in charge of interpreting the personal values and instructions given by the patient, but only when such power has been expressly attributed to him in the prior instructions document.
In order to process the living will in Murcia it is necessary to provide the following documentation:
- Granting of advance directive document.
- Application for registration of the prior instructions document in the Registry.
- Certified photocopy of the DNIs or passports of the participants: grantor, witnesses (if any) and representative (if any).
- Responsible statement signed by all witnesses.
- Statement that accredits the representative/s (if any), accepted and signed by him/her/them.
