What does the Living Will consist of?
We put at your disposal a very simple form to leave your instructions on the care or treatments you want or do not receive and to appoint the representatives to act as interlocutors before the responsible medical team. This document can be made by a person of legal age, capable and free, and with the same freedom and requirements, its content can be revoked or modified. Keep in mind that if the patient cannot and there is no advance directive document, the relatives will intervene.

The living will in Madrid is a document through which any person expresses their wishes in advance about the care and treatment of their health so that this will is fulfilled at the time they reach certain clinical situations, at the end of his life, that they prevent him from expressing his will personally.
In the Comunidad de Madrid the living will can be done by any person of legal age who is qualified and acts freely. Contrary to how it happens in other autonomous communities, in Madrid minors cannot process the living will on their own, in which case it will be the parents or legal guardians of the minor who will decide on how to act and what to do about the care doctors to apply to the minor when the time comes.
This document can be created by filling in an available template, in paper or digital format. According to the regulations, there are 2 modalities when processing the living will in Madrid and thus record the prior instructions: with three witnesses or by going to a public or private hospital or health center in the Comunidad de Madrid. In the case of witnesses, they must be of legal age and with full capacity to act and, in addition, at least two of them cannot have a kinship relationship until the 2nd by consanguinity or affinity or be linked by any type of relationship with the grantor person.
At the time of processing the living will or prior instructions, there is the possibility of appointing a representative, so that, if necessary, he or she can serve as an interlocutor with the medical personnel who care for the patient to ensure compliance with the previous instructions. The representative must accept and sign said responsibility in writing and watch over it when the time requires it.
In order to process the living will in Madrid, it is necessary to provide the following documentation:
- Granting of advance directive document.
- Application for registration of the prior instructions document in the Registry.
- Photocopy of the IDs or passports of the participants: grantor, witnesses (if any) and representative (if any).
- Responsible statement signed by all witnesses.
- Statement that accredits the representative/s (if any), accepted and signed by him / them.

What regulations exist to regulate the Living Will in Madrid?
In the Comunidad de Madrid the living will, after regulation at the national level in 2002, is managed and processed based on a Decree published by the Comunidad de Madrid in 2006.
Decree 101/2006, of November 16, of the Governing Council, which regulates the Register of Prior Instructions of the Comunidad de Madrid.
Order 2191/2006, of December 18, which develops Decree 101/2006, of November 28, which regulates the Register of Prior Instructions of the Comunidad de Madrid and establishes the official models.
Order 645/2007, of April 19, of the Minister of Health and Consumption, which regulates the granting of the Prior Instructions, their modification, replacement and revocation before the personnel at the service of the Administration.
