What does the Living Will consist of?

We put at your disposal a very simple form to leave your instructions on the care or treatments you want or do not receive and to appoint the representatives to act as interlocutors before the responsible medical team. This document can be made by a person of legal age, capable and free, and with the same freedom and requirements, its content can be revoked or modified. Keep in mind that if the patient cannot and there is no advance directive document, the relatives will intervene.

The living will in the Comunidad Valenciana is a document through which a patient decides, with full conscience, what type of medical care they wish to receive in the event of terminal illness and who will represent them, before the team health, when, after losing consciousness, it is necessary to interpret your wishes or decide on the medical treatment to be applied.

In the Comunidad Valenciana, the living will can be done by any person of legal age or emancipated minor and with sufficient legal capacity to decide freely. Unlike in other autonomous communities, in the Comunidad Valenciana minors can process the living will of their own free will, as long as they are legally emancipated. If they are not, the father or mother or legal guardian of the minor must decide what to do and how to act on the medical treatment to be applied to the minor.

This document can be created by filling in an available template, in paper or digital format. As indicated in the regulations, there are 2 ways to process the living will in the Comunidad Valenciana and thus make the declaration of advance directives: by a notary or by three witnesses. In the case of witnesses, they must be of legal age, with full capacity to act, and at least two of them may not be linked to the interested party by reason of marriage, unmarried partner, relationship until the 2nd of blood relationship or affinity or any patrimonial relation.

When processing the living will or the declaration of advance directives, there is the possibility of appointing a representative, who can be any person of legal age, who has not been legally incapacitated. The representative will act as an interlocutor before the healthcare team in making decisions about the medical treatment to be applied to the patient, in addition to being able to interpret the personal values and instructions of the grantor when he or she cannot express his or her own will.

In order to process the living will in the Comunidad Valenciana it is necessary to provide the following documentation:

  • Request for registration of the advance directive document.
  • Photocopy of ID, passport or any official document that proves the identity of the participants: grantor, witnesses (if any) and representative (if any).
  • Grantor’s statement that it has no relationship to at least two of the witnesses.
  • Document accrediting the representative (if any), accepted and signed by the representative.
  • If before a notary, also: authentic copy of the power of attorney granted by the notary for this purpose.

In the Comunidad Valenciana, you can obtain more information and process the registration of the advance directives document at the central services of the Ministry of Health located at 31 Micer Mascó Street, at any of the Territorial Directorates of the Ministry of Health, and in most of the Patient Information and Care Services (SAIPs) of the public hospital network of the Comunidad Valenciana. If processed before a notary, any notary in the Comunidad Valenciana can access the centralized registry of advance directives electronically through the corresponding recognized digital certificate issued by the Notarial Certification Authority (ANCERT), by the Certification Authority of the Comunidad Valenciana (ACCV), or by any certification service provider with which the Valencian Government has established the appropriate recognition agreement.

What regulations exist to regulate the Living Will in the Comunidad Valenciana?

In the Comunidad Valenciana, the living will, after regulation at the national level in 2002, is managed and processed based on a Decree published by the Generalitat Valenciana in 2004.

DECREE 168/2004, of September 10, of the Consell de la Generalitat, which regulates the Document of Advance Directives and creates the Centralized Register of Advance Directives of the Comunidad Valenciana.
