What does the Living Will consist of?

This document can be made by a person of legal age, capable and free, and with the same freedom and requirements, its content can be revoked or modified. Keep in mind that if the patient cannot and there is no advance directive document, the relatives will intervene.

The living will in Castilla-La Mancha is a document that includes the citizens’ declaration of advance directives in written form with the instructions that must be taken into account regarding the healthcare that the person wishes to receive in situations that prevent you from personally communicating your will, guaranteeing that these instructions will be carried out as long as the conditions established in the legislation are met.

In Castilla-La Mancha the living will can be done by any person of legal age, with full capacity to act and who acts freely. However, unlike in other autonomous communities, minors are not allowed to process a living will. In these cases, the father or mother or legal guardian of the minor will have the last word on what to do and how to act on the care of the minor.

This document can be created by filling in an available template, in paper or digital format. According to the regulations, there are 3 ways to process the living will in Castilla-La Mancha and thus make the declaration of advance directives: before a notary, before three witnesses or before an official of the Registry of Advance Directives of Castilla-La Mancha. In the case of witnesses, they must have full capacity to act and at least two of them must not be related to the grantor by kinship of up to 3rd degree of consanguinity or affinity, by marriage or by any professional or patrimonial relationship.

When processing the living will or the declaration of advance directives, there is the possibility of appointing a representative who will act as a valid interlocutor with the doctor or healthcare team in making decisions about the medical treatment that has been to apply to the grantor. Any person of legal age who is not legally incapacitated may be the representative of the patient who grants this document and it is necessary for that person to know their appointment and sign their acceptance.

In order to process the living will in Castilla-La Mancha it is necessary to provide the following documentation:

  • Document registration request signed by the grantor and the representative.
  • IDs or passports of the grantor, the witnesses (if applicable) and the representative (if applicable).
  • Writ of acceptance of the representative, if there is one designated.
  • If it is with witnesses, a responsible statement from two of the witnesses stating that they meet the aforementioned requirements.
  • If it is before a notary, also: authorized copy of the declaration granted before a notary, therefore, the simple copy is not allowed.

In Castilla-La Mancha, you can get more information and process the declaration of advance directives in the Provincial Directorates of the Ministry of Health, in the User Care Services of certain hospitals and in the Institute of Health Sciences. In any case, the application for registration signed by the grantor must be submitted by himself or by a representative with a power of attorney to that effect in person from Monday to Friday from 9:00 a.m. to 2:00 p.m., recommending requesting a prior appointment to avoid you wait.
