What does the Living Will consist of?

This document can be made by a person of legal age, capable and free, and with the same freedom and requirements, its content can be revoked or modified. Keep in mind that if the patient cannot and there is no advance directive document, the relatives will intervene.

The living will in Cantabria is called a document of previous wills
The living will in Cantabria is a document that contains the statements of citizens about the health care they wish to receive when they are in a situation, predictably irreversible and terminal, in which they cannot manifest themselves. Thus, persons of legal age can express their will in advance so that it is fulfilled if situations arise in which circumstances they are not able to express their will personally about the care and treatment of their health.
In Cantabria the living will can be made by any person of legal age and with full legal capacity to act and act freely. However, unlike other autonomous communities, minors do not have the right to create or process a living will. In these cases, the father, mother or legal guardian of the minor will have the power to make the necessary decision when the time comes.
This document can be created by filling in an available template, in paper or digital format. As indicated by the regulations, there are 3 ways to process the living will in Cantabria and thus manifest the advance directives: by a notary, by three witnesses or before an official of the Ministry of Health and Social Services.
When processing the living will or the declarations of previous wills, there is the possibility of appointing one or more representatives who will act as valid interlocutors with the doctor or healthcare team in making decisions about medical treatment to be applied to the grantor. Any person of legal age who is not legally incapacitated may be the representative of the patient who grants this document and it is necessary for that person to know their appointment and sign their acceptance.

In order to process the living will in Cantabria it is necessary to provide the following documentation:
- Document registration request signed by the grantor and the representative (s).
- Certified copies of the DNIs or passports of the witnesses (if applicable) and, where appropriate, of the representative.
- Original signed of the prior will document.
- Writ of acceptance of the representative, if there is one designated.
- If it is with witnesses, responsible statement from two of the witnesses stating that they do not have a relationship until the 2nd degree or employment, property or service relationship, or relationship marital nor of analogous affectivity to the conjugal with the grantor.
- If before a notary, also: authenticated copy of the notarized document.
In Cantabria, you can obtain more information and process the declarations of previous wills in the Registry of the Ministry of Health, in any public registry of the Autonomous Administration or in any of the points included in the Law of Administrative Procedure. It may also be sent by post to the Register of Prior Will of the Ministry of Health and Social Services of the Government of Cantabria, located at Calle Federico Víal, nº 13, Santander. or appear at the Customer Service points of the hospitals or Health Centers of the Cantabrian Health Service.

What regulations exist to regulate the Living Will in Cantabria?
In Cantabria, the living will, after regulation at the national level in 2002, is managed and processed based on a Decree published by the Government of Cantabria in 2004.
Decree 139/2004, of December 5, by which the Registry of Prior Will of Cantabria is created and regulated.
Decree 2/2012, of January 12, which modifies Decree 139/2004, of December 5, which creates and regulates the Registry of Prior Will of Cantabria.
