What does the Living Will consist of?

We put at your disposal a very simple form to leave your instructions on the care or treatments you want or do not receive and to appoint the representatives to act as interlocutors before the responsible medical team. This document can be made by a person of legal age, capable and free, and with the same freedom and requirements, its content can be revoked or modified. Keep in mind that if the patient cannot and there is no advance directive document, the relatives will intervene.

The living will in Asturias is called a prior instructions document

The living will in Asturias is a document by which a person expresses his will in advance about the care and treatment of his health with the sole objective that it be fulfilled at the time that specific situations occur in whose circumstances you are not able to express it personally and can no longer make decisions.

In Asturias, the living will can be done by any person over 18 years old, capable and free. And it is that this document allows citizens to express in advance the health care and treatments they want to receive when they can no longer make decisions. In the case of minors, that responsibility falls on the father, mother or legal guardian. In addition, the citizen may express his will about the donation of his organs and tissues and the transfer of his body to teaching or research upon death.

This document can be created by completing an available template, in paper or digital format. According to the regulations, there are 3 ways to process the living will in Asturias: before a notary, before three witnesses or before the Administration. This process is called bestowal. In the Administration modality, the procedure is carried out personally before the official in charge of the Registry.

At the time of processing the living will or the document of previous instructions there is the possibility of the appointment of a representative who will be the interlocutor before the doctor or the health team and will ensure compliance with the previous instructions . The declaration contained in the document shall prevail over the opinion and indications that may be made by family members, relatives and professionals who participate in their health care, as long as it does not contravene the current legal order and lex artis at that moment. In the event that there are several prior instructions documents from the same grantor in the Registry, the content of the last document granted will be taken into account.

In order to process the living will in Asturias it is necessary to provide the following documentation:

  • Authenticated photocopy of the identity card or passport of the grantor.
  • Original of the advance directive document if it was formalized directly with the Administration.
  • If the document has been formalized before a notary: authorized copy of it.
  • If the document has been formalized before witnesses: the original of the document and certified photocopies of the national identity document, or the passport of the witnesses.
  • The request may also be presented through a representative, and in this case, your representation must be accredited by any valid means in Law that leaves a reliable record.

In Asturias, more information can be obtained from the Ministry of Health, the User Care and Social Work Services of the hospital network, and the Primary Care Health Centers. However, the living will or document of prior instructions must be presented at the Headquarters of the Registry of Previous Instructions, located in the Inspection Service of Services and Health Centers, Calatrava Building, on Calle Ciriaco Miguel Vigil , nº9, in Oviedo. For the granting or formalization of the document of previous instructions before the official in charge of the Registry it is necessary to request an appointment.

What regulations exist to regulate the Living Will in Asturias?

In the Principado de Asturias, the living will, after regulation at the national level in 2002, is managed and processed based on a Decree published by the Principado de Asturias in 2008.
