What does the Living Will consist of?
We put at your disposal a very simple form to leave your instructions on the care or treatments you want or do not receive and to appoint the representatives to act as interlocutors before the responsible medical team. This document can be made by a person of legal age, capable and free, and with the same freedom and requirements, its content can be revoked or modified. Keep in mind that if the patient cannot and there is no advance directive document, the relatives will intervene.

The living will in Andalucía is called the advance vital will document
The living will in Andalucía is a written document that contains the preferences about the health care and treatments that a person wishes to receive, so that they are taken into account and are complied with at the time when they do not have the capacity to express them personally. However, the document cannot include instructions that go against any law (euthanasia, for example) or that are not clinically approved.
In Andalucía, a living will can be made by any person of legal age and who can express himself freely in his right mind. It can also be processed by emancipated minors and those legally incapacitated as long as the incapacitation sentence does not prevent it and they are in a situation of capacity at the time of formalizing their Declaration.
This document can be created by filling in an available template, in paper or digital format. Unlike in other autonomous communities, in Andalucía the figure of the witnesses or the notary is not necessary to register the living will, so all the process can be done online, except for the face-to-face appointment to finish the processing process .
If desired, the regulations allow a trusted person to be chosen as a representative to decide for the patient when the difficult situation arises. In addition, a second representative person can even be chosen to act as a substitute to intervene if the first representative person is unable to do so for any reason. The representatives must also sign the document.
In order to process the living will in Andalucía it is necessary to provide the following documentation:
- DNI, NIE or Passport.
- The living will or advance directive document duly completed and signed.
- The representatives’ original DNs, NIEs or Passports, or a certified copy of them.

What regulations exist to regulate the Living Will in Andalucía?
In the Comunidad Autónoma de Andalucía, the living will, after regulation at the national level in 2002, is managed and processed based on a Law published by the Andalucía Government in 2003.
