    What are the requirements and terms of the orphan’s pension?

    If the death is prior to 1-1-2008, it will be necessary to prove a contribution period, which will vary according to the deceased’s employment situation and the cause that determines the death:

    • In discharge or situation assimilated to discharge, 500 days within an uninterrupted period of 5 years immediately prior to death or 15 years throughout the entire working life.
    • Not high: 15 years throughout the entire working life.
    • Pensioners: No contribution period is required.

    If the death is after 1-1-2008 and the deceased was in discharge or a situation assimilated to discharge, no prior contribution period is required. Nor is a prior contribution period required, when death occurs as a consequence of an accident or occupational disease.

    The children of the deceased deceased may be beneficiaries of the orphan’s pension and, in certain circumstances, those contributed by the surviving spouse who are:

    • Persons under 21 years of age or older disabled with a degree of absolute permanent disability or major disability.

    How to calculate the orphan’s pension?

    The economic benefit of the orphan’s pension is calculated applying the percentage of 20% to the corresponding regulatory base, this being different according to the employment situation of the deceased on the date of death and the cause determined by the death.
